In February 2008, Rodney Dewayne Harris filed a suit against his employer, Equity Group—Alabama Division d/b/a Keystone Foods, alleging that he had injured his back in a workplace accident on July 6, 2007. Although Keystone Foods denied the allegations, the trial court held an evidentiary hearing and found in Harris's favor.
Keystone Foods appealed this decision but the Alabama Court of Civil Appeals affirmed in part, reversed in part, and remanded. They agreed with the trial court's determination that Harris had suffered a workplace accident that Keystone had received sufficient notice of. However, they found that the trial court erred in granting Harris the right to select a physician from a panel of four provided by Keystone, and in awarding benefits retroactive to the date of the accident rather than the date of notice.
