Back Injury Leads to Permanent Total Disability for Nurse

Patricia Holloway, a Certified Nursing Assistant at Shadescrest Health Care Center, fell on a puddle of water in January 2001 and injured her back. Despite enduring surgery and physical therapy, her back pain persisted.

When she tried returning to work under modified duties, Holloway found it too painful. The trial court found Holloway permanently and totally disabled and awarded benefits accordingly. Shadescrest appealed claiming Holloway refused reasonable accommodation and vocational rehabilitation.

However, the Court of Civil Appeals of Alabama affirmed the trial court's judgment holding that the trial court's judgment declaring Patricia Holloway permanently and totally disabled was supported by substantial evidence from the trial.
