The Court of Civil Appeals rejected the defendant’s claim that the plaintiff’s back injury was not related to a previous work accident.

This case pertains to a workers' compensation lawsuit brought by William H. Hughey against Jesse Stutts, Inc. for a back injury, which he claimed, was due to a previous work accident in 2002. Hughey had been compensated for his 2002 injury and later started experiencing further back problems, resulting in a need for surgery. The company denied responsibility, citing Hughey’s subsequent fall at another job in 2011 as the cause of the further injury, and appealed a trial court decision which had found in favor of Hughey.

However, The Court of Civil Appeals of Alabama rejected the defendant’s argument, ruling that the plaintiff had provided substantial evidence to demonstrate that his herniated disk and annular tear were the direct result of the injuries he received in the 2002 accident. Hence, Stutts, Inc. must pay for the surgery and was found in contempt for violating future medical provisions of their 2004 settlement agreement.
