Exposure to Hazardous Chemicals Limited to Workers' Compensation Remedies

This case revolves around workers at a Dallas County factory alleging that their employers were responsible for exposing them to hazardous working conditions. The workers claimed that their employers deliberately, negligently, or carelessly exposed them to harmful chemicals which caused them a range of bodily injuries.

However, the Court of Civil Appeals of Alabama affirmed the trial court’s decision that these tort claims were barred by the Workers' Compensation Act's exclusivity provisions. The Court reasoned that the claim alleged injuries from exposure to hazardous conditions in the workplace, which falls within the employer's role under the Act. Therefore, even proving an intent on the part of the employer to injure will not remove the case from the Act's scope.
