Deborah Holloway Weaver filed an appeal from a judgment in favor of Pilgrim's Pride Corporation filed by the Colbert Circuit Court. Thomas Joseph Weaver, her late husband, died after falling from a grain silo at the company's location. A claim for death benefits was submitted by Weaver's widow based on the Alabama Workers' Compensation Act.
Pilgrim's Pride denied the claim, stating Weaver's employment had already been terminated before his fall or that he jumped intentionally. The company moved for judgment in its favor claiming Weaver had no reason to be atop the silo on the death day. The judgment lacked necessary findings of fact or conclusions of law, therefore the Court of Civil Appeals of Alabama reversed the judgment and remanded the case for compliance.
