Spouse of Deceased Worker Entitled to Benefits Accrued

In the case of General Electric v. Baggett, the General Electric Company appealed from a judgment awarding workers' compensation benefits to Mary Ann Baggett, after her husband, a former General Electric employee, was deemed permanently disabled due to a left-leg injury incurred at work.

Mr. Baggett sued for compensation in 2003 for his left ankle and knee injuries suffered in 2001. While the appeal was pending, Mr. Baggett died from unrelated causes. Following this, Mrs. Baggett pursued compensation for accrued benefits, leading to a dispute on her entitlements under Alabama Code § 25-5-57(a)(5).

The Court of Civil Appeals affirmed that she was entitled to the compensation benefits due her deceased husband.
