In this case, El Reposo Nursing Home Group sought mandamus relief (a judicial review) from an order by the Lauderdale Circuit Court to cover the expenses for treatment of Carole Patterson, their employee's work-related injury. At the heart of the issue was if Patterson's need for pain management treatment was related to her work injuries.
The Circuit Court had already ordered El Reposo to pay for Patterson's treatment, as they determined her pain was caused by the work injury. El Reposo contested, arguing that the authorized treating physicians, Dr. Jones and Dr. Morris, had found the ongoing pain not related to her work accident but to a pre-existing condition. Despite El Reposo's arguments, the Court of Civil Appeals denied their appeal. The court stated that the physicians’ opinions could not override the previous decision also noting that whether or not they considered it necessary, the physicians themselves had mentioned pain management treatment.
