Richard Purser sought workers' compensation benefits from his employer, (Winn-Dixie Montgomery, LLC) for an injury he sustained while at work. Winn-Dixie denied liability. The trial court found Purser's injury arose out of and in the course of his employment, thereby making Winn-Dixie responsible for the payment of reasonable and necessary medical treatment and that Purser was entitled to temporary-total-disability benefits.

Winn-Dixie appealed, arguing that the medical evidence was not properly authenticated. The appeal court rejected the claim due to the lack of hearing transcript. Since Winn-Dixie failed to ensure the hearing was transcribed, the court assumed that the unrecorded oral evidence was sufficient to uphold the trial court's findings. The appeal was thus denied.
