Jeff White, a former employee of HB & G Building Products, appealed a judgment that found HB & G was no longer obligated to provide workers' compensation benefits for a knee injury he sustained while in their employment.
After leaving HB & G Building Products, White worked for Cutt's Restaurant and claimed that the work aggravated his knee injury. The Court of Civil Appeals, however, found that the activities engaged in during his employment with Cutt's had aggravated a preexisting condition, and thus, HB & G no longer had responsibility for White's workers' compensation benefits based on the 'last-injurious-exposure rule'.
On appeal, the judgment was reversed as substantial evidence did not support the finding that a second injury to White's right knee arose out of his employment with Cutt's or that White had aggravated his previous injury.
