Staph Infection Work-Related, Benefits Awarded

The case revolves around a judgment awarding workers’ compensation benefits to Benjamin Dean Madison who contracted a staph infection due to a wound on the right wrist and boils in the left armpit which he allegedly sustained while working for W.A. Kendall & Company, Inc. in Texas and Alabama.

The trial court found both of these cases as factors of causation for his condition and concluded that W.A. Kendall had received proper notice regarding the boils and awarded Madison permanent total disability benefits and future medical expenses. W.A. Kendall appealed the decision, arguing that Madison's staph infection was caused by the wound on his right wrist, not the boils, and that proper notice regarding the wound was not received.

While the Court of Civil Appeals agreed that the boils were not the cause of the staph infection, it did not make a finding on the issue of notice and remanded the case back to the trial court for a finding on that issue.
