Permanent Total Disability Reversed and Remanded for Further Review

The court reversed and remanded a judgment from a lower court declaring Cheryl D. Morgan permanently and totally disabled as a result of an on-the-job injury. The court found that the lower court had not adequately addressed elements required by Alabama law.

Morgan claimed she was injured at work on Dec 5, 2003 at a Georgia Pacific plant. However, the defendant (Fort James Holding Co., GP) argued through various claims that the injury occurred in November 2003 and Morgan did not avail herself of care provided by GP. Her claim was initially denied in 2004. The appeal court resolved that the lower court had to determine who was responsible for covering her medical expenses.
