In 2006, Marvin Jackson filed a complaint against Delphi Automotive Systems, alleging that he was injured while working at their facility in a work-related incident in 2004. His injuries were related to lifting and transporting large, heavy buckets of paint.
After the trial court ruled in favor of Delphi Automotive Systems, Jackson presented evidence that he had received full pay while on restricted duty, which he argued, had served to toll the statute of limitations. Upon review, the Alabama Court of Civil Appeals held that there was a genuine issue of material fact regarding whether Jackson's full-pay status was considered a continuation of his benefits.
The court found that Delphi Automotive Systems had not met its burden of counteracting this claim. The judgment granted to Delphi was reversed and remanded for further proceedings.
