Short, an employee of Domino's, had sustained an injury that was covered under Alabama Workers' Compensation Act, and required the employer to pay for the employee's recommended medical treatment.
The Court of Civil Appeals elected to treat the appeal as a petition for writ of mandamus. However, because the trial court hadn't made findings of fact and conclusions of law as required by the Act, the court denied Domino's petition. The Court ordered the trial court to enter an order containing appropriate findings of fact and conclusions of law, noting the appeal can only lie in the presence of a final judgment.
