This lawsuit pertained to a workers' compensation claim filed by Hennon Hollinghead against his employer, Advantage Resourcing, Inc. Hollinghead suffered injuries due to a slip-and-fall accident at his job site and sought medical and temporary-total-disability benefits under the Alabama Workers' Compensation Act.
A decision by the Mobile Circuit Court granted the benefits to Hollinghead and obligated the employer to permit him to undergo a surgical procedure related to his injuries. Advantage Resourcing disagreed with the original court's decision, arguing that appeal and not mandamus was the appropriate mechanism for seeking a review of the trial court’s order.
However, as the trial court’s order did not adjudicate all claims as to all parties, Appeal was rejected. The employer also disputed the trial court's decisions with regard to both causation prongs of the injury. After reviewing the merits of the case, the Alabama Court of Civil Appeals denied the employer’s appeal upholding the trial court’s ruling.
