Daniel Reed, an employee of Diamond Scaffold Services Group Inc., filed a workers' compensation case in Washington County after suffering a back injury while working at a ThyssenKrupp construction site. Diamond Scaffold petitioned to change the venue of the case to Mobile County, arguing that the accident occurred in Mobile County, the company's principal office location.
Despite evidence provided by Diamond Scaffold, the Washington Circuit Court denied the motion. Consequently, Diamond Scaffold petitioned the Court of Civil Appeals of Alabama to overturn this decision. The appellate court granted Diamond Scaffold's petition, stating that evidence showed the accident occurred in Mobile County, and Diamond Scaffold's principal office was located there. ThyssenKrupp, which had facilities in both Washington and Mobile Counties, was not a defendant in the case, so its location was irrelevant to the venue decision.
