Class Action Certification Dismissed for Lack of Subject Matter Jurisdiction

In this case, Alabama Mutual Insurance Corporation (AMIC) appealed from the trial court's order certifying a class in the action filed by the City of Vernon and a class of similarly situated entities related to workers' compensation rights. Vernon, the original class representative, alleged that in 2005, AMIC revised its coverage form to exclude employees from collecting both Workers Compensation and Uninsured Motorist benefits when involved in an automobile accident.

After the appeal, Vernon settled its claims with AMIC and withdrew as the class representative. Consequently, the Alabama Supreme Court remanded the case to trial court, allowing 120 days for a new class representative to be substituted for Vernon. On remand, the trial court named the City of Fairfield as the new class representative. Upon review of the case, the Supreme Court determined that the trial court was without subject-matter jurisdiction over this dispute. As a result, they vacated the trial court's class-certification order and dismissed the appeal.
