Plaintiff Failed to Prove Company Policy was Enforced in Discriminatory Manner

This is a workers' compensation case where the employer M & J Materials appealed the Jefferson Circuit Court judgment in favor of the employee, Stanford D. Isbell. Mr. Isbell was claiming that he was fired unjustly for asserting his worker's compensation right after a workplace injury.

M & J Materials claimed that he was fired because of reported open possession of a firearm in the company premises. Although Mr. Isbell provided evidence of his claim, it was determined he did not show that M & J Material implemented their weapon policy in a discriminatory manner or acted outside company policy. Therefore, the Appeals Court found that Mr. Isbell was not fired solely for asserting his worker's compensation rights and reversed the judgment favoring Mr. Isbell, calling for a judgment in favor of the employer.
