Plaintiff Awarded Benefits by Appellate Court

In the case of Johnson v. Lowe's Home Centers, Inc., Dorrian D. Johnson appealed to the Autauga Circuit Court's judgment in his workers' compensation action. Previously, the circuit court had ruled that Johnson's injury was not compensable under the Workers' Compensation Act. But the Court of Civil Appeals of Alabama overturned the decision.

According to the opinion, after reviewing Johnson’s medical records, deposition testimonies and other relevant evidence, the appellate judge found that the trial court’s determination that Johnson’s injury didn’t occur at work was not supported by substantial evidence. Considering Johnson's consistent accounts of his injury occurring at work by lifting a stocked toilet while employed at Lowe's, mixed with other testimonies and documentations, the appellate judge found there was enough evidence to support Johnson's claim that his injury did occur at work. 

The Court of Civil Appeals passed judgement for the case to be returned to the Autauga Circuit Court, and for the lower court to determine the benefits to which Johnson is entitled and to enter a judgment awarding those benefits.
