No Error in Defense Verdict in Pulmonary Embolism Misdiagnosis Claim

Alisa Ansley, administrator of the Estate of James W. Ansley, filed an appeal with the Supreme Court of Alabama (Bullock County), regarding a wrongful death action case against INMED Group, Inc. (d/b/a Bullock County Hospital). This case followed the death of James W. Ansley from pulmonary embolism misdiagnosis. Ansley claimed the Bullock County Hospital failed to diagnose James' condition and transfer him to a facility equipped to treat the problem, thereby causing his death.

The jury returned a verdict in favor of all defendants, supporting the argument that Dr. Domingo, the physician in charge, did his best for the patient and the pulmonary embolism event that resulted in James' deterioration was unforeseeable. Ansley filed a motion for a new trial, arguing the court committed errors in relation to the standard of care applicable to a hospitalist, the admissibility of the financial status of the hospital, among others. The Supreme Court of Alabama found no errors by the lower court, affirmed the original verdict, and denied the plaintiff's motion for a new trial.
