Robert and Tabitha Snell sued AMMC, P.C., doing business as Alabama Men's Clinic, and Dr. John Justin Caulfield for medical malpractice. Initially, the jury decided in favor of AMMC and Dr. Caulfield. However, the Snells discovered juror misconduct and filed for a new trial which was granted by the trial court.
Although the Alabama Supreme Court affirmed the judgment of the trial court, Justice Sellers disputed this. He was of the opinion that the Snells were not prejudiced by the three jurors who failed to disclose during voir dire that they or their relatives had been defendants in lawsuits.
