Defendant's Motion to Transfer Venue Denied and Affirmed- Failed to Prove it would be Significantly More Convenient

Veolia Environmental Services faced a workers compensation lawsuit filed by Christopher Herring in the Etowah Circuit Court. The company filed a motion to dismiss or change venue under the forum non-conveniens statute, seeking to transfer the case to the Talladega Circuit Court on the bases of convenience.

Their argument was supported by an injury report form showing Veolia's address and evidence that Herring's injury occurred on the Veolia premises. The motion was denied as the court ruled that Veolia had failed to prove that it would be significantly more convenient or just to transfer the lawsuit. Hence, Veolia's petition for a writ of mandamus was denied.
