Tyson Chicken, Inc. appealed a worker's compensation lawsuit because they believed it was improperly filed in Etowah County, where the plaintiff resided. They argued the case should have been filed in Marshall County, where the plaintiff's injury occurred. The Alabama Supreme Court agreed with Tyson, ruling that the plaintiff had not established that Tyson conducted business by agent in Etowah County, as required by the state's venue statute, and as such, venue was not proper in Etowah County. The Court thereby issued a writ directing the transfer of the case to Marshall County.
